1 - 1. USE OF ACCOMMODATION AND PREMISES

The tenant shall use the premises according to the purpose of use of the premises.  The rental agreed between the parties of this contract cannot be of benefit to a third party other than those mentioned on the contract, unless by written agreement by COEUR CARAÏBES company.  The tenant, signatory of the herein contract agrees for a given period, cannot claim under any circumstances a right to stay in the premises at the end of the rental period.

2 - NUMBERS OF TENANTS

The number of tenants cannot exceed that indicated on the contract without a preliminary agreement by “COEUR CARAÏBES”.  CŒUR CARAÏBES Company reserves the right to refuse the extra lessee(s) or to cancel the contract without compensation.  Insofar as there is an agreement, the rental price will be increased accordingly as determined by the Management.

3 - ANIMALS

Pets are not allowed on the site

4 - AIR-CONDITIONING

The price includes the working of air-conditioning from 9:00 pm to 6:00 am.  Doors and windows will have to be closed if air conditioners are used.  All air-conditioners are pre-set for a temperature ranging from 23°C to 24°C. For any other adjustment of temperature or ventilation, the lessee must contact a representative from the management of the business.  Remote controls must not be removed, or left in reach of children.  Failure to comply with these estate rules and any consequential damage will be charged for.  (For your information: the cost for an air conditioner remote control is 105 €)

5 - DEPOSITS

Upon arrival, the customer is to provide two deposits to the property management.
- First deposit of 150 € to cover any material damage.
- The second deposit will cover any possible cleaning fees for the accommodation (floor, crockery etc.) ; 2 people, 30 €, 60 € for 4 people, and 90 € for over 4 people.
The deposits will be returned subject to the checking of the inventory of fixtures, upon the departure of the lessee or by mail in the event of the inventory of fixtures could not be done prior to the departure of the lessee.

6 - INVENTORY OF FIXTURES

 The lessee agrees to return the premises upon departure in the state found upon arrival.  In the event of failure to observe the above clause fees for the cleaning of the premises will be charged to the lessee and the deposit mentioned in the fifth article will be lost. An inventory will be done by a representative of COEUR CARAÏBES, at the beginning and at the end of the rental period.
The cost of any lost or damaged object will be deducted from the deposit money or, in the event that the value of damages is greater than the deposit an invoice will be given to the lessee to account for the greater cost.

7 - PAYMENT

7_1 Booking

Reservation
Reservation will be confirmed as soon as the lessee has sent a 30% down payment to “COEUR CARAIBES” of the total amount of the stay by CB, bank or post office cheque payable to “COEUR CARAIBES SARL”, a returned and signed copy of the rental contract before the date mentioned on the contract.

7_2 the balance

The rental balance will be settled (CB, cheque, in cash or holiday vouchers) upon the hand over of keys for the stay.

8 - CANCELLATION CONDITIONS

Any cancellation must be notified by registered letter with acknowledgement of receipt or by telegram and will bring about a fixed deduction of 50 Euros for administrative charges.
8_1 notified cancellation less than 90 days before entering into possession of the estate. The down payment is refunded to the lessee, deduction done of the before mentioned administrative charges
Cancellation notified between 89 and 30 days before entering into the accommodation rent:  The down payment, less the administrative charges mentioned above, lead to a credit note usable for a similar service in our organization.  This is valid for the 12 months following the reservation date.  Beyond this period, the credit note will have no value any longer and the down payment is non-refundable.
notified cancellation between 29 and 15 days before entering into possession of the premises: 
The down payment is non refundable.
8_4 notified cancellation less than 15 days before entering into possession of the estate:
The down payment is non refundable and the organization reserves the right to claim the balance of the accommodation rental.
8_5 interruption of the stay by the customer:
Interruption of the stay by the client will not lead to any refund. Upon the lessee’s departure, the accommodation is available again.

9 - INSURANCE

CŒUR CARAIBES draw customers’ attention on the opportunity to take out an insurance contract covering consequences resulting of a cancellation in certain circumstances, as well as insurance for personal objects.  Actually, no personal objects of lessees can be covered by the owner’s insurance.

10 - DISPUTES

In the event of a failure to reach an out-of-court settlement with the management of COEUR CARAIBES, all claims have to be sent to “COEUR CARAIBES” by registered letter with acknowledgement of receipt 8 days at the latest after the end of the stay
Any dispute about the descriptive state or the inventory of fixtures will not be accepted by the management beyond the third day of occupation
In the event of failure to come to an agreement between the parties, the decision of the Crown Court of the locality shall take precedence.
